Maggie has been my solicitor for a number of years – in all that time, I have found her to be professional, hardworking, honest and respectful. She has shown compassion, empathy and helped my family through the toughest times when we needed it most. I have recommended her to friends and relatives, who have also then gone on to recommend her and her firm.

Empathy, dedication and passion are three words I would use to describe Maggie Orman and her team. Maggie has been my family lawyer for over 10 years and has guided me through many difficult periods of my life, and ensured I came out the other end a stronger woman and mother. Maggie is rational, compassionate and highly ethical. I felt that she truly cared about me, my family and our wellbeing. Maggie’s skilful advice and counsel achieved an incredibly quick resolution, and kept costs to a minimum. I will continue to use Maggie Orman Solicitors for all my family law requirements and highly recommend her to anyone requiring a family lawyer.

What does a family lawyer do?

A family lawyer, or family law solicitor, specialises in legal matters related to family relationships. They provide advice, support, and representation in situations involving separation, divorce, parenting arrangements, property settlements, and other family-related issues.

To learn more about what a family lawyer typically does, read the full answer in our blog on what a family lawyer does.

What should I look for when choosing a family lawyer?

Choosing the right family lawyer (or family law solicitor) is an important decision that can significantly impact the outcome of your case.

Some important factors to consider include: expertise in family law, communication skills, problem-solving approach and more. Find the full list of factors in our blog.

How do I file for divorce in NSW?
Filing for divorce in New South Wales (NSW) involves several steps to ensure compliance with Australian family law.

The first step is to “confirm eligibility;” namely to ensure you meet the following criteria:

  • Residency: You or your spouse must be an Australian citizen by birth, descent or by grant of Australian Citizenship, or have lived in Australia for the 12 months immediately before filing and you intend to continue living in Australia (you must have a valid or current visa.)
  • Separation period: You must have been separated for at least 12 months and 1 day. It’s possible to be separated while living under the same roof; however, additional evidence will be required in such cases.

To learn about the next step and additional considerations, follow this link to access our full blog post.

What happens if my partner and I can’t agree on property or parenting arrangements?

If you and your partner cannot agree on property or parenting arrangements after separation, there are several steps you can take to resolve the dispute. Australian family law encourages out-of-court resolution whenever possible, but the court process is available if necessary.

The first step is to attempt to resolve the dispute amicably, first through direct negotiation and then, if necessary, through mediation or family dispute resolution (FDR).

For a complete breakdown of the steps, check out our blog on the subject.

What does ‘no fault’ divorce mean?

‘No fault’ divorce means that a couple can legally end their marriage without needing to prove that one spouse is responsible for the breakdown of the relationship. In Australia, this principle is governed by the Family Law Act 1975 (Cth), which removed the need for allegations of wrongdoing, such as infidelity or cruelty, as a basis for divorce.

For a full list of the key features of a no-fault divorce, click through to our blog on the matter.

How do I know if I need a family lawyer?

Deciding whether you need a family law solicitor often depends on the complexity of your situation and the potential legal consequences. Common scenarios where consulting a family law solicitor is highly recommended include: “You’re considering separation or divorce,” parenting disputes, property and financial matters are unclear, etc.

What are my rights during a separation?

Your rights during a separation depend on your circumstances, but there are several key legal principles in Australian family law that protect you.

These rights are designed to ensure fairness and clarity during what can be a challenging time.

For example, Here’s what you need to know about your rights when it comes to Equal Parental Responsiblity:

1. Right to Equal Parental Responsibility

  • For Parents: Both parents have equal shared parental responsibility for their children, regardless of separation. This means you both have the right to participate in making major decisions about the children’s welfare, education, and healthcare unless a court orders otherwise.
  • Living Arrangements: The court focuses on the best interests of the child when determining parenting arrangements. You have the right to seek a fair and practical parenting plan or court order.

To learn more about your rights on the Right to a Fair Division of Property, the Right to Financial Support and much more, read our full blog on the topic.

How are assets divided after separation or divorce?

In Australia, the division of assets after separation or divorce is governed by the principle of what is “just and equitable,” as outlined in the Family Law Act 1975.

The process involves assessing the financial and non-financial contributions of each party, as well as their future needs, to reach a fair outcome.

The process begins by identifying and valuing the assets and liabilities, assessing contributions, considering future needs and determining what is “just and equitable.”

For a thorough break down, please visit our blog.

What is a Binding Financial Agreement, and do I need one?
A Binding Financial Agreement (BFA) is a legally enforceable document under the Family Law Act 1975 in Australia that sets out how financial matters will be handled between you and your partner.

It can address property division, spousal maintenance, and other financial issues, providing clarity and certainty in the event of a relationship breakdown.
